iKandi Sunglasses — Oakley Meta Vanguard AI Giveaway
  1. Promoter. The promotion is conducted by iKandi Sunglasses, ABN: 86301200347 of 12 Central Park Ave, Ashmore QLD 4214.
  2. Promotional period. The promotion commences at Thursday 9th July 6am AEST and closes at [Monday 13th July 5pm AEST ("Promotion Period"). Entries received outside this period will not be accepted.
  3. Eligibility. 3.1. Entry is open to Australian residents aged 18 years or over, who hold a valid Instagram account, except: 3.2. Employees (and their immediate families) of the Promoter, Oakley, Luxottica, and agencies associated with this promotion are ineligible to enter. 3.3. Entry is limited to one (1) entry per person during the Promotion Period. Multiple or bonus entries (e.g. via Story share) are limited to one per method as specified in the promotional post.
  4. How to enter. To enter, during the Promotion Period entrants must, via the Promoter's official Instagram account @ikandisunglasses: 4.1. Follow the account; 4.2. Like the nominated giveaway post; and 4.3. Comment on the post tagging at least one (1) other genuine Instagram user. No purchase is necessary to enter. Entrants may optionally share the post to their Instagram Story and tag the Promoter for one additional entry.
  5. Prize. One (1) winner will receive one (1) pair of Oakley Meta Vanguard AI Performance Glasses, colour/style as pictured, subject to availability. Total prize pool value: approximately $789 AUD (based on RRP at time of promotion). The prize is not transferable or exchangeable and cannot be redeemed for cash. If the specified prize is unavailable, the Promoter reserves the right to substitute the prize with a product of equal or greater value, subject to any written directions from a regulatory authority.
  6. Winner selection. The winner will be selected by random draw from all eligible entries, conducted electronically, within 2 business days of the Promotion Period closing. The draw will take place at. iKandi Sunglasses Head Office

    . The decision of the Promoter regarding any aspect of this promotion is final, and no correspondence will be entered into.
  7. Notification. The winner will be notified via Instagram direct message and/or comment reply within 3 business days of the draw, and announced publicly via Instagram Story on the Promoter's account. The winner must respond to the notification within 7 days and provide requested details (name, delivery address, contact number) to claim the prize. If the winner does not respond within this time, the Promoter reserves the right to void that entry and select a replacement winner via redraw.
  8. Prize delivery. The prize will be shipped to the winner's nominated Australian address within 5 business days of claim confirmation, at no cost to the winner. The Promoter is not responsible for prizes lost or delayed in transit once dispatched with a tracked delivery service.
  9. Instagram disclaimer. This promotion is in no way sponsored, endorsed, administered by, or associated with Instagram or Meta Platforms, Inc. Information provided by entrants is submitted to the Promoter iKandi Sunglasses and not to Instagram or Meta. Any questions, comments or complaints regarding this promotion must be directed to the Promoter, not to Instagram.
  10. Personal information and privacy. By entering, entrants consent to the Promoter collecting and using their personal information (including name, Instagram handle, delivery address and contact details where provided) for the purpose of conducting this promotion, including contacting the winner and fulfilling the prize. The Promoter may also use winners' first names and Instagram handles in connection with promotional and marketing activity relating to this giveaway (e.g. announcing the winner), unless the entrant objects. Personal information will be handled in accordance with the Promoter's Privacy Policy, available at [ikandisunglasses.com.au/privacy-policy].
  11. Conduct and disqualification. The Promoter reserves the right to disqualify any entrant who tampers with the entry process, submits an entry that is fraudulent, offensive, or in breach of Instagram's own terms of use, or otherwise fails to comply with these Terms and Conditions.
  12. Liability. To the extent permitted by law, the Promoter (including its officers, employees and agents) excludes all liability for any loss, damage, personal injury or death that may arise from participation in this promotion or from the acceptance or use of the prize, except for any liability that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or other applicable law that cannot lawfully be excluded.
  13. Unclaimed prize. If the prize remains unclaimed 5 days after the winner is first notified, the Promoter reserves the right to conduct an unclaimed prize draw, [if required by the relevant jurisdiction] with details of any such draw made available on request.
  14. General. The Promoter reserves the right, at its sole discretion, to amend these Terms and Conditions, or to cancel, suspend or modify the promotion, if it becomes necessary to do so for reasons outside its control (e.g. technical failure, unauthorised intervention), subject to any written directions from a relevant regulatory authority. These Terms and Conditions are governed by the laws of Queensland, Australia.
  15. Permit status. This promotion has a total prize pool value below the threshold requiring a trade promotion lottery permit in all applicable Australian states and territories at the time of publishing, and is conducted as an exempt/no-permit-required trade promotion in accordance with the relevant gaming legislation of each jurisdiction.
